La llegada de los españoles a América, sin duda marca un punto de partida y quiebre en temas de creencias, cultos, prácticas existentes, entre otros, en este territorio. Con los españoles, en este nuevo territorio “supuestamente nuevo y virgen” la diversidad religiosa se fue dejando de lado, imponiéndose como única religión la católica, excluyendo todas las demás de manera absoluta, la cual se vio afianzada con el Patronato Indiano. Durante el siglo XIX se gestó en América del Sur la lucha por la independencia de la corona Española. Sin embargo, la primera constitución peruana de 1823 y las siguientes, expresaron formalmente que la religión católica era la única y oficial válida en el territorio peruano. De esta manera, el siglo XX es el inicio de la Libertad Religiosa en el Perú, elevándola a nivel constitucional. Así, la Constitución de 1933 consagró un articulado en donde se otorga el derecho a las demás religiones en el ejercicio de sus cultos, dando paso a un brote de diversidad religiosa. Por otra parte, durante el gobierno militar del General Velazco Alvarado en 1979, el Estado Peruano deja de ser confesional, y las relaciones entre Iglesia Católica u el Estado Peruano, tiene como característica fundamental la autonomía e independencia del uno frente al otro. Ya en el siglo XXI se ha avanzado aún más jurídicamente hablando en el desarrollo de la diversidad y libertad religiosa. Por ejemplo, se crea en el año 2002 la Dirección de Asuntos Interconfesionales en el Ministerio de Justicia, entidad estatal dirigida a las confesiones religiosas distintas de la católica. También se creó la Ley de Libertad Religiosa (2011), promulgada el 16 de Diciembre del 2010, Ley N° 29.635. De esta manera, Perú es un país de profunda diversidad religiosa, el derecho a la igualdad la tiene cada confesión religiosa pero que se debe ir ganando en el tiempo. During the nineteenth century it was conceived in South America's struggle for independence from the Spanish crown. However, the first Peruvian constitution of 1823 and the following, formally stated that Catholicism was the only official valid in Peruvian territory. Thus, the twentieth century is the beginning of Religious Freedom in Peru, elevating it to a constitutional level. Thus, the 1933 Constitution devoted an articulated in which the right is granted to other religions in the performance of their services, leading to an outbreak of religious diversity. Moreover, during the military government of General Velasco Alvarado in 1979, the Peruvian State ceases to be religious, and relations between the Peruvian Catholic Church and the State, has as main feature the autonomy and independence of facing each other. Already in the XXI century it has advanced further in legal terms in the development of diversity and religious freedom. For example, in 2002 created the Department of Interfaith Affairs in the Ministry of Justice, State entity directed to different Catholic denominations. Religious Freedom Act (2011) was also created, promulgated on December 16, 2010, Law No.29,635. Thus, Peru is a country with deep religious diversity, the right to equality of each religious confession but should be gaining in time. |
