El presente proyecto de tesis tiene por objetivo determinar el efecto tributario que produce al realizar transacciones con empresas fantasmas o inexistentes en la Compañía “EQUIL S.A.” en el Ejercicio Fiscal 2012, por ello se realizó una investigación descriptiva, de campo y bibliográfica que ayude a mejorar el proceso de planificación tributaria, para dicho efecto se recopiló la información necesaria para su análisis, en las áreas de la organización. Por lo cual el mecanismo más eficaz que ayude a evitar sanciones de la Administración Tributaria es elaborar una Planificación Tributaria eficiente aprobado por el Gobierno Corporativo cuya aplicación evitará prácticas de evasión fiscal y salvaguardara los recursos financieros de los Administradores, Ejecutivos, Empleados y el Estado. Con tal aplicación la Compañía “EQUIL S.A.” no estaría expuesta a recibir una Determinación Tributaria por el Organismo de Control y el Sujeto Pasivo aportará en mantener la Cultura Tributaria en el Ecuador, contribuyendo proporcional y equitativamente con el desarrollo económico-social del País.
The purpose of this thesis project is to determine the tax effect it produces when making transactions with ghost companies or non-existent companies in the "EQUIL SA" Company in Fiscal Year 2012, for this reason a descriptive, field and bibliographical investigation was carried out to help improve the tax planning process, for this purpose the necessary information was collected for analysis in the areas of the organization. Therefore, the most effective mechanism that helps to avoid sanctions of the Tax Administration is to elaborate an efficient Tax Planning approved by the Corporate Government whose application will avoid practices of tax evasion and safeguard the financial resources of the Administrators, Executives, Employees and the State. With such application the Control Body would not expose the Company “EQUIL S.A.” to receive a Tax Determination and the Passive Subject will contribute in maintaining the Tax Culture in Ecuador, contributing proportionally and equitably with the economic and social development of the Country.
